1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2. Entry is open to residents of Australia. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3. The promotion commences at 9:00am Australian Eastern Daylight Saving Time (“AEDST”) on Monday 01/02/2010 & closes at 5:00pm AEDST on Sunday 14/03/2010 (“Promotion Period”).
4. To enter, purchase any Nestlé confectionery product from a participating store then choose the way you would like to send your entry. (Keep the wrapper for every entry made during the Promotion Period in a safe place in case the Promoter requires you to validate every entry made during the Promotion Period.)
a. Online – go to
www.wincashhourly.com.au and follow the prompts to enter the last 4 digits of the Nestlé confectionery product barcode and your contact details. Note that online entry requires a valid email address.
b. Mobile phone – send a SMS message to 1999 6767 the following information, with each item separated by a space: the last 4 digits of the barcode from the Nestlé confectionery product, your first name & last name & your home postcode (e.g. 9876 space JOHN space CITIZEN space 2001). Note that text entry may not be available from all mobile phone carriers or plans.
5. Entry may not exceed once per calendar day and each entry must be for a separate purchase is of a Nestlé confectionery product. Any form of automated entry using any other devices or software is invalid.
6. The Promoter reserves the right to require any entrant to provide the product wrapper for every entry they made during the Promotion Period, including non-winning entries, in order to claim a prize. The Promoter retains the absolute discretion to require any entrant, (including groups of entrants in the same Household), to provide proof of residency at the Household address shown on their entry before awarding a prize.
7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques designed to avoid payment of call costs or for making multiple entries that are not associated with the separate purchase of a Nestlé confectionery product, or for submitting an entry which is not in accordance with these conditions of entry.
8. The cost of sending an SMS entry is the responsibility of the entrant and will vary depending on the mobile network used. Total cost of SMS entry will not exceed 55 cents including GST.
9. All eligible entries received during the Promotion Period will be included in the next occurring hourly prize draw and also the unclaimed prize draw (if required).
10. Prize is $50 which will be awarded as a cheque made payable to the name the winner provided in their winning entry. There are a total of 336 prizes to be awarded.
11. A prize draw will occur eight times each day of the Promotion Period at Suite 104, 55 Beach Street, Port Melbourne, Victoria 3207, commencing Monday 01/02/2010 and finishing Sunday 14/03/2010. Prize draws will occur at one minute past the hour starting at 10.01am AEDST and concluding at 5.01pm AEDST. The first valid entry drawn will win the prize, (ie. 8 prizes awarded each day).
12. All prize winners will be notified by phone within 48 hours of their prize win and also notified in writing with the prize despatch. Each Monday commencing 8/02/2010, the names and postcodes of the preceding week’s winners will appear at
www.nestle.com.au/whatsnew .
13. Total prize pool is valued at $16,800.
14. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
15. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting
www.nestle.com.au or calling 1800 005 510.
16. Promoter’s decision is final and no correspondence will be entered into.
17. The Promoter may conduct an unclaimed prize draw at 12 noon at the same place as the original draws on 16/06/2010 to distribute any prizes that have either not been awarded or unclaimed by that date subject to any written directions given by a relevant lotteries or gaming authority. The first valid entry drawn will win the unclaimed prize and the draw will continue until all unclaimed prizes have been distributed. The name and postcode of any winner of an unclaimed prize will appear at
www.nestle.com.au/whatsnew by 23/06/2010.
18. Prize will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.
19. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
20. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
